  2. An Attorney -in-Fact was appointed by a relative abroad thru a consularized SPA. The agent, a senior citizen, can not perform the transactions in the SPA because of the pandemic. The agent wish to substitute a nephew as her substitute, the principal abroad agreed to this substitution. What document will the Attorney-in-Fact need to execute to effect this substitution.   3. Kapag walang naka indicate na expiration date ang isang SPA, yung mismong signatory ng attorney with date of his license expiration, pwede na ba yun ang maging date validity ng isang SPA? Ex: license expires on 31 Dec 2020.. then pirma ng attorney.. by January 1, 2021 lapse na ang SPA? Please enlighten me more. Thanks in advance..

    1. The answer is already in the FAQ: “if you haven’t indicated a validity period in the SPA, it will remain effective until you have it revoked.” The license expiration date has nothing to do with it.

  5. My son is separated with his wife and they have two children. And my son is living with another woman. They are planning to buy a house and the mortgage is a single applicant named to the woman. I will put the down payment . Can she make a general power of attorney with my sons name? If she passed away god forbid please will son have the sole power to execute to the full extent of all the properties.

  9. Kailangan po ba yung personal appearance nung mga signatories (i.e. principal, attorney-in-fact and witnesses) pag pinanotarize na yung document? Kasi in my case po, yung dad ko yung principal but he cannot leave the house kasi PWD siya.
